Thank you for your email of 16th July, a copy of which I attach.

 

Dealing with the points you have made and adopting your numbering, I would comment as follows:-

 

1.         Thank you.

 

2.         It is unusual to have pre-booked private events at a premises of this type.  We envisage having clients holding anniversaries and birthday parties.  We have clients who are loyal to Joel Robuchon and the brand.  My clients advise me that they have customers who when they are in London would make a point of coming to Joel Robuchon.  The deli allows these customers to also enjoy purchasing high quality goods.

 

3.         With regard to any tables and chairs outside, we are not permitted to red line any area outside, as this is highways and not owned by my clients.  If we would like to have tables and chairs outside there are a whole host of requirements in relation to this, which need to be met as far as the planning application is concerned and the tables and chairs licence is concerned from Westminster.  All these applications require consultation.

 

4.         Noted.

 

5.         Please note that these conditions have been discussed with my client and as I have said in my previous email we would be prepared to accept these conditions on the premises licence should the application be granted.

 

6.         Your proposed condition 7 reads as follows.  “Taxis shall not be allowed to wait in the street for patrons with their engines left on.”  The entrance to these premises is on Piccadilly, which is a red route.  Vehicles are not permitted to stop outside.

 

7.         Condition 8 reads “No tables and chairs outside the premises.”  As my clients have indicated it is not essential for the business, however, this is not a condition that we would agree to and of course my clients can discuss this with the residents at the meeting.

 

8.         You refer to your condition 9 with regard to food and drink which will be purchased and taken away from the premises.  I will take instructions with regard to immediate consumption and come back to you on this.

 

9.         Thank you.  If this application is granted, then we can of course offer to Committee a condition regarding any dedicated delivery service accessing the premises via Bolton Street and using the loading bay inside the building.

 

            Dealing with the separate points made in Huw Jones’s representation:-

 

a.       It is not unusual to have a start time of 08.00 for alcohol for premises such as these.  Premises who provide off sales of alcohol, for example, supermarkets, delis, convenience stores allow for the sale of alcohol from 08.00.  Bearing in mind that these premises will cater for clientele from all over the world, it is not unusual for persons to perhaps enjoy a Bloody Mary or glass of champagne with their breakfast.  Please note that alcohol can only be served to customers by waiter/waitress service and who are seated at all times.

 

b.       The application is for premises with modest hours.  You have requested to indicate on the premises licence that the premises  are a high class delicatessen. This is not something that has been requested by any of the Responsible Authorities and this application has not caused any concern for the Police whatsoever. 

 

c.       I believe this would be acceptable to my clients.  I await hearing from them in relation to this.

 

I have asked my clients whether they are available on 22nd or 23rd July, as you have indicated.  I will let you know as soon as I hear from my clients regarding this.
